General Terms and Conditions

I. REGISTRATION
 

1. With submission of the registration and confirmation of the course by the swim school, the contract becomes legally binding. By registering, the course participant, or in the case of minors their legal guardian, agrees to pay the course fee.
 

2. With this legally binding contract, the course participant, or in the case of minors their legal guardian, also agrees to comply with the safety and access regulations of the respective swimming facility. Failure to comply with these rules may result in exclusion from the course. In such cases, there is no entitlement to a refund of the course fee.


3. If participation in a booked course is not possible for an important reason, the swim school must be informed in writing (or by email) as early as possible. Cancellation of the course is possible up to 14 days before the course begins.
 

4. Non-attendance or early termination of the course does not entitle the participant to a refund or exemption from payment of the course fee.
 

5. If a lesson is cancelled by the swim school (e.g. due to instructor illness, technical issues, or other unforeseen events), the lesson will be rescheduled. A refund is not possible. If no replacement date can be offered, the lesson will be refunded accordingly.


6. Courses can only take place if a minimum number of 5 children is reached. There is no legal entitlement to the course taking place upon registration. If a course does not take place due to insufficient participants, an alternative date will be offered or the course fee will be refunded.

 

II. PAYMENT TERMS
 

1. The course fee must be paid upon registration to the SW!MM ACADEMY bank account, including the participant’s name and course name, but no later than within 14 days. Only timely receipt of payment entitles participation in the course.
 

2. For cancellations up to 14 days before the course starts, the course fee will be refunded minus a €25 processing fee. Cancellation must be made in writing. For late cancellations (less than 7 days before the start of the course), cancellations on the day of the course, or non-attendance, the full course fee is due. A replacement participant is accepted.

 

III. LIABILITY / INSURANCE COVERAGE
 

1. Insurance coverage provided by SW!MM ACADEMY is limited to the duration of the course.
 

2. We are only liable in cases of intent or gross negligence.
 

3. We are not liable for self-inflicted damages by the course participant. The swim school is not responsible for any property damage caused by the participant.
 

4. Accompanying persons and/or legal guardians who are present during the course do so at their own responsibility. No insurance coverage is provided by SW!MM ACADEMY.


5. We accept no liability for valuables or personal belongings.

 

IV. OFFERS / PRICES
 

All offers are non-binding. Printing errors and mistakes cannot be excluded. All information is therefore subject to change.
 

The prices valid at the time of contract conclusion apply.

 

V. GUARANTEE OF SUCCESS
 

No guarantee is given for the success of any course.

No liability is accepted for not achieving the course objectives.


 

VI. RULES OF CONDUCT
 

1. The rules of the swimming facility must be observed.
 

2. Parents and children must follow the instructions of the course instructor.


3. In case of serious violations of general rules of conduct, participants, accompanying persons, and/or legal guardians may be excluded from the course without entitlement to compensation.

 

VII. SUPERVISION DUTY

 

1. Baby courses and individual beginner lessons:
Supervision lies with the parents or accompanying person during the course.

 

2. Beginner and continuation courses:
Supervision lies with the instructor during the course. Parents or accompanying persons must personally ensure that the instructor is present before handing over the child. The child must be handed over in swimwear, fully showered, at the pool edge.

 

3. Supervision does not apply if the child has not been personally handed over to the instructor.

 

VIII. ILLNESS AND MAKE-UP LESSONS
 

1. Missed lessons cannot be made up.
 

2. There is no entitlement to refunds or credit for missed lessons.


In case of illness, we are happy to provide practice instructions to help independently catch up on the missed content.

Illnesses that prevent participation in swimming lessons until full recovery include:
 

  • contagious childhood diseases (measles, chickenpox)

  • fever

  • inflammation of eyes, ears, or sinuses

  • gastrointestinal infections and diarrhea

  • contagious skin diseases

  • after vaccinations



IX. DATA PROTECTION
 

1. Mobile numbers are used to create broadcast lists (WhatsApp). These are used to reach groups quickly.


2. Photography and filming during courses is generally NOT allowed. In the final lesson, we offer the opportunity to take photos of your baby/child.
 

3. All contact data remains in our customer system after the course for future information about new courses and events. Deletion of personal data is possible upon request at any time.
